THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2016 (AS AMENDED)

NOTICE UNDER REGULATION 28(4)SEVERN TRENT WATER: GRINDLEFORGE WTW PATHOGENS

THE SECRETARY OF STATE:

  1. has received a report from Severn Trent Water (the “Company”) dated 02 February 2018 (the “Report”) which states that there is or has been a significant risk of supplying water from Grindleforge WTW that could constitute a potential danger to human health.
  2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Cryptosporidium
  • E.coli and Coliform bacteria

Requirements

(a) to maintain the following measures for the period specified in each case

  1. Continuous real time on line turbidity and chlorine monitoring.
    Date: For the duration of the Notice
  2. Enhanced monitoring of raw and final water for bacteriological parameters and Cryptosporidium.
    Date: For the duration of the Notice
  3. Continue to improve competency of operational staff, in particular in the identification and management of risk relating to drinking water quality.
    Date: For the duration of the Notice
  4. Continue to optimise existing treatment systems.
    Date: For the duration of the Notice
  5. Maintain catchment surveillance and make interventions to mitigate potential contamination.
    Date: For the duration of the Notice

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Review and confirm the appropriateness of the proposed solution to provide Ultra Violet (UV) disinfection to secure or facilitate compliance with statutory requirements.
    Date: 31 March 2020
  2. Confirm completion of design and expected start date for construction of the agreed solution.
    Date: 31 May 2021
  3. Complete construction and commissioning of the agreed solution.
    Date: 31 December 2023

(c) to audit whether the measures have been effective by the following means:

  1. Define a strategy for auditing the effectiveness of the above measures.
    Date: 31 March 2020
  2. Implement the audit strategy outlined in (c)1

(d) n/a

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

  1. Provide a progress report annually by 31 January and against the following milestones:
    • Confirmation of the appropriateness of the proposed solution and details of the strategy for auditing the effectiveness of the measures to be made operation.
      Date: 30 April 2020
    • Confirm completion of design and expected start date for construction of the proposed solution.
      Date: 30 June 2021
    • Confirm completion of construction and commissioning of the proposed solution.
      Date: 31 January 2024
  2. Review the risk assessment for Grindleforge WTW as required by Regulation 27(4) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
    Date: Ongoing for duration of the notice
  3. Submit a satisfactory completion report.
    Date: 31 January 2025

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Act.
