Details of this Notice:
- The Drinking Water Inspectorate (‘the Inspectorate’) has received a regulation 28(1) report of the Water Supply (Water Quality) Regulations 2018 (‘the Regulations’) from the company dated 20 September 2025, which states that there is or has been a significant risk of supplying water from service reservoirs, contact tanks, and treated water storage tanks (and associated assets as applicable) that could constitute a potential danger to human health or could be unwholesome.
- Consequently, this Notice is served on the company by the Inspectorate on behalf of the Welsh Ministers, under regulation 28(4) for the assets listed above, for risks associated with:

- The company are required to satisfy the following requirements.
The date given is that until or by which the requirements must be maintained or satisfied, as appropriate.
Requirements:
(a) To maintain the following measures for the period specified in each case:
- Operate all tanks in accordance with company policy, standards, and procedures, aligning with recognised standards of good practice.
Date: Ongoing for the duration of this Notice - Carry out investigatory sampling in response to any microbiological exceedances, in line with company procedures at all of the company’s service reservoirs and treated water storage tanks.
- Continue to carry out inspection and maintenance of company sampling facilities in line with company procedures.
Date: Ongoing for the duration of this Notice - Maintain records and evidence of the remedial work on all the company’s treated water tanks sampling points, to ensure a robust audit trail.
Date: Ongoing for the duration of this Notice - Maintain appropriate contingency plans for any tanks listed in Annex 1 (including liaison with relevant stakeholders as appropriate) to protect human health.

(b) To review, revise or make operational the following measures, by the dates specified in each case:
- Critically review the ‘minimum operational standard’ for regulatory sampling facilities to ensure that it details the required standard to ensure a representative sample.
Date: 28 February 2026 - Review the method of documenting sample tap surveys to ensure that these are conducted appropriately in line with the minimum operational standard policy, including the use of appropriate photographic evidence. Include a review of staff training material and refresher training material. Ensure all staff training is up to date.
Date: 31 March 2026 - Conduct a review of the sampling facilities for all sites listed in Annex 1 against the requirements of the company’s minimum operational standard. Ensure these checks are appropriately documented with appropriate photographic evidence of the sampling facilities.
Date: 31 March 2026 - Develop a programme of work to complete required solutions to address the improvements identified in (b)3.
Date: 31 May 2026 - Complete the programme of work to bring all sampling facilities up to the minimum operational standard as identified in measure (b)3.
Date: 31 May 2027 - For any sites that are not listed in Annex 1, ensure that sampling facilities are reviewed within 1 year following the completion of (b)1 and (b)2, and any remedial work recorded on DWSP and remedial work progressed following Company procedures. Any significant remedial work should be prioritised.

(c) To audit whether the measures have been effective by the following means:
- Define an audit strategy to monitor the effectiveness of the measures specified in sections (a) and (b).
Date: 15 March 2026 - Implement, and keep under continuous review, the audit strategy defined in measure (c)1.
Date: Following completion of measure (c)1. onwards.
(d) Not to supply water for regulation 4(1) purposes from WTWs or Service Reservoirs, or not to so supply unless the specified conditions below are satisfied:

(e) To provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risks:
- Provide a progress report annually.
Date: by 31 January each year. - Provide a report on the critical review conducted in (b)1 and the actions raised.
Date: 31 March 2026 - Provide a report on the documentation review, and training review, in measure (b)2.
Date: 30 April 2026 - Provide a report of the sampling facilities review conducted in (b)3, and the actions raised from the review.
Date: 30 April 2026 - Provide the programme of works, as required in (b)4, including dates, to complete the actions identified in (b)3.
Date: 30 June 2026 - Confirm completion of the programme of works as required in measure (b)5.
Date: 30 June 2027 - Provide a report on the review conducted on all remaining WTWs and SRVs in the Dwr Cymru asset base as required by measure (b)6.
Date: 31 March 2027 - To remove an asset from Annex 1, submit a report on a bi-annual basis. This report must include evidence of actions completed, or evidence of the survey where no actions were raised, include reference to (a) measures for the duration the asset was in Annex 1.
Date: 30 June 2026, 31 December 2026 and 30 June 2027 - Submit the audit strategy for auditing the effectiveness of the measures, as specified in measure (c)1.
Date: 15 April 2026 - Submit any revisions of the audit strategy produced under measure (c)2.
Date: Within 1 month of a revision - Submit a report in the event that any completed measures of this Notice need to be altered in any way, for any reason.
Date: Ongoing for the duration of this Notice - Submit a satisfactory completion report accompanied by a revised regulation 28(1) report with Board level Director sign-off.

Further Details of this Notice:
- Any product or substance used as a result of the requirements in this Notice must comply with regulation 31.
- Under regulation 28(6) the Inspectorate, on behalf of the Welsh Ministers, may by notice served on the company, revoke or vary this Notice.
- Failure by the company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991 (as amended).
