THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2016 (AS AMENDED)

NOTICE UNDER REGULATION 28(4)

South East Water Services Ltd : LOOSE SERVICE RESERVOIR

THE SECRETARY OF STATE:

  1. has received a report from South East Water Services Ltd (the “company”) dated 05 November 2019 (the “Report”) which states that there is or has been a significant risk of supplying water from Loose Service Reservoir that could constitute a potential danger to human health and could be unwholesome.
  2. GIVES NOTICE to the company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Coliforms, E coli, Clostridia and Enterococci due to the risk of ingress.

Requirements

(a) to maintain the following measures for the period specified in each case:

  1. Continue to undertake external inspections and maintenance at standard frequency.
    Date: Ongoing for the duration of the Notice.
  2. Continue to sample the storage asset to check compliance at the frequency defined by the annual South East Water Sampling Programme.
    Date: Ongoing for the duration of the Notice.
  3. Continue to monitor treated water storage level via the South East Water Control Centre.
    Date: Ongoing for the duration of the Notice.
  4. Continue to undertake grounds maintenance and vermin control as required.
    Date: Ongoing for the duration of the Notice.

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Identify an enhanced sampling programme for the asset. Notify the company’s liaison Inspector of any operational detections that to do not currently meet the company’s event notification threshold.
    Date: Ongoing for the duration of the Notice.
  2. Complete risk based Remotely Operated Vehicle inspections as required at Loose Service Reservoir.
    Date: until assets can be removed from supply.
  3. Plan and undertake enabling works to remove treated water storage asset from supply for inspection and integrity testing.
    Date: 30 November 2020
  4. Complete the internal inspection and integrity testing for Loose Service Reservoir.
    Date: 31 December 2021
  5. Complete appropriate control measures for any defects identified.
    Date: 30 April 2021
  6. Upon the discovery of active ingress into any treated water storage assets.
    Date: until assets can be removed from supply
    • Implement immediate short-term mitigation measures to ensure public health is protected.
    • Remove the asset from supply and complete the required remedial works.
  7. Where the company is unable to meet part (b)6, devise and implement a solution to remove the asset from supply at the earliest opportunity and notify the Inspectorate as an Event.
    Date: until assets can be removed from supply

(c) to audit whether the measures have been effective by the following means:

  1. Define and keep under continuous review an audit strategy to monitor the effectiveness of the above measures.
    Date: 30 September 2020
  2. Implement the audit strategy defined in (c)1.
    Date: For the duration of the Notice.

(d) not to supply water for regulation 4(1) purposes i.

  1. Not applicable

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

  1. Provide a progress report annually by 31 January and against the following milestones:
    • Report detailing the rationale of why the asset cannot readily be removed from supply with evidence to support conclusions.
      Date: 31 January 2021
    • Report detailing Programme of Work to complete enabling work for isolation and repair of storage asset.
      Date: 31 January 2021
    • Report detailing the outcome of internal inspections, inundation testing, proposed remedial action and timeframes.
      Date: 31 January 2022
  2. Review the risk assessment for the storage asset as required by regulation 27(3) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
    Date: From time to time and by 21 December 2022
  3. Submit a satisfactory completion report.
    Date: 31 January 2023

Failure by the company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991.
