THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2016 (AS AMENDED)

NOTICE UNDER REGULATION 28(4)

THE SECRETARY OF STATE:

  1. has received a report from South Staffordshire Water (the “Company”) dated 01 October 2018 (the “Report”) which states that there is or has been a significant risk of supplying water from Slade Heath Pumping Station that could constitute a potential danger to human health and could be unwholesome.
  2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Pesticide associated product Tetrachloroterephthalic acid (Pesticide – Chlorthal)

Requirements

(a) to maintain the following measures for the period specified in each case:

  1. Operation of the current treatment arrangements for pesticides (Granular Activated Carbon Contactors)
    Date: Until completion of section step b)3.
  2. Regulatory and operational sampling for laboratory analysis and pesticide treatment control.
    Date: for the duration of this notice
  3. Continue with catchment management risk mitigation activities.
    Date: for the duration of this notice
  4. Report any deterioration in pesticide risk, in accordance with the Information Direction and/or as required by regulations 27 and 28 of the Water Supply (Water Quality) Regulations 2016 (as amended)
    Date: for the duration of this notice
  5. Investigate, risk assess and review any pesticide exceedance and take suitable action to inform and protect public health.
    Date: for the duration of this notice

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Confirm timetable, programme and location for installation of ion exchange treatment, or other identified solution.
    Date: 30 June 2023
  2. Complete the planning, design and procurement arrangements for the installation of ion exchange treatment, or other identified solution.
    Date: 31 March 2024
  3. Complete the construction, installation and commissioning of ion exchange treatment, or other identified solution.
    Date: 31 March 2025

(c) to audit whether the measures have been effective by the following means:

  1. Pesticide samples to be collect weekly from associated boreholes and final compliance monitoring point.
    Date: for the duration of this notice
  2. Collect monthly samples from customer’s taps from the associated supply zones.
    Date: for the duration of this notice

(d) not to supply water for regulation 4(1) purposes from Slade Heath Treatment Works

  1. Not Applicable

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

Provide a progress report annually by 31 January and against the following milestones:

  1. Confirmation of timetable, programme and location for installation of ion exchange treatment, or other identified solution.
    Date: 31 July 2023
  2. Completion of the planning, design and procurement arrangements for the installation of ion exchange treatment, or other identified solution.
    Date: 30 April 2024
  3. Completion of the construction, installation and commissioning of the ion exchange treatment, or other identified solution.
    Date: 30 April 2025
  4. Review the risk assessment for Slade Heath Treatment Works as required by regulation 27(3) and subsequently submit a revised regulation 28 report accompanied by a signed board level declaration.
    Date: ongoing as required and by 30 May 2025
  5. Submit a satisfactory completion report as per section c)3.
    Date: 30 April 2026

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991.
