THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2016 (AS AMENDED)

NOTICE UNDER REGULATION 28(4)

ANGLIAN WATER: AMP7 Water in Buildings

All Anglian Water Supply Systems

THE SECRETARY OF STATE:

  1. has received a report from Anglian Water (the “company”) dated 29 December 2017 (the “Report”) which states that there is or has been a significant risk of supplying water in buildings, that could constitute a potential danger to human health.
  2. GIVES NOTICE to the company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • TCP
  • Clostridium perfringens, coliform bacteria, E. coli, Enterococci
  • Colony counts
  • Cryptosporidium
  • Copper
  • Discolouration
  • Taste and/or odour
  • Hydrocarbons
  • Iron
  • Lead
  • Manganese
  • Nickel
  • Particles
  • Sodium
  • Solvents
  • Turbidity
  • Zinc

Requirements

(a) to maintain the following measures for the period specified [in each case]:

  1. Proactive inspection programme of existing non-domestic properties as required based on the assessed risks posed by the internal plumbing. Assessments conducted in line with company procedures.

  2. Reactive inspections following water quality contacts from customers.
    Date: Ongoing for the duration of the notice
  3. Reactive investigations following sample exceedances, in line with company procedures.

  4. Continue with an enhanced programme of two yearly inspections on all domestic properties classed as ‘very high’ risk.

  5. Continue the Company’s whole-site protection policy for all new domestic connections.

  6. Delivery of an extensive customer education and communication strategy and development of proactive customer education, awareness and behavioural change campaign and proactive promotion of safe plumbing.

  7. Continue to review advice and literature given to customers on potential risks associated with defective plumbing within factsheets, via the website and through other media.

  8. Continue to provide NVQ training modules at plumbing colleges within the region.

  9. Continue to identify property types and prioritise by risk assessment using the company’s existing database.

  10. Meet the requirements of Regulation 21 of the Water Supply (Water Quality) Regulations 2016 (as amended).

  11. Continuing assessment of risks posed by customers’ plumbing in line with Regulation 27.

(b) to review, revise and/or make operational the following measures, by the date specified below:

  1. Short term measures
    1. Make operational with immediate effect from 1 April 2020 and maintain until revocation of this notice the short-term measures identified below:

      • Identify property types and prioritise by risk assessment using company’s existing database.
  2. Medium term measures
    1. Make operational with immediate effect from 1 April 2020 and maintain until revocation of this notice the medium term measures identified below;
      Date: Ongoing for the duration of the notice
      • Extend the scope of proactive inspections of public buildings with consideration given to the likely risks given by the plumbing installed.
      • Develop and implement a ‘point of use’ trial.
      • Develop an approach for collaboration with Trading Standards to aid the sale of compliant fittings within the Anglian Water region.
      • Further develop our customer awareness and behavioural campaign.
  3. Long term measures
    1. Continually appraise the risks posed by customers’ plumbing as part of the Regulation 27 Risk Assessment for all supply systems according to a Drinking Water Safety Planning approach and ensure that Regulation 28 documents are regularly reviewed, and updates provided as necessary.

(c) to audit whether the measures have been effective by the following means:

  1. Define a strategy for auditing the effectiveness of the above measures by 30 September 2020 including the following:
    Date: Complete
    • Monitor the percentage of named types of public buildings inspected each year.
    • Details of enforcement of these properties.
    • Types of breaches of Water Fittings found.
    • Details of the point of use installation trial outputs.
    • Details of the trading standards collaborative outputs.

The above information shall then be used to inform strategies such as WaterSafe and other such campaigns.

  1. Implement the audit strategy outlined in (c)1 until revocation of this notice.

(d) not to supply water for regulation 4(1) purposes unless the conditions specified below are satisfied:

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

  1. Provide a progress report annually by 31 January and against the following milestones:
    Date: Annually by 31 January
    • Details of the remedial steps that comprise the programme of work including confirmation of the delivery timescales, completion dates and all interim steps.
  2. Submit a report to confirm the audit/monitoring strategy for the demonstration of benefit phase.
    Date: Complete
  3. Review the risk assessment for water in buildings for all supply zones as required by Regulation 27(4) and subsequently submit a revised regulation 28 report accompanied by board level sign off from time to time, and by 30 September 2024.

  4. Submit a satisfactory completion report.
    Date: 31 October 2025

Failure by the company to comply with this Notice may result in enforcement proceedings under section 18 of the Water Industry Act 1991.
