THE WATER SUPPLY (WATER QUALITY) REGULATIONS 2016 (AS AMENDED)

NOTICE UNDER REGULATION 28(4)

NORTHUMBRIAN WATER LTD: AMP7 Mosswood Disinfection

THE SECRETARY OF STATE:

  1. Has received a report from NORTHUMBRIAN WATER (the “Company”) dated 11 March 2019 (the “Report”) which states that there is or has been a significant risk of supplying water from Mosswood WTW that has been identified as a potential danger to human health.
  2. GIVES NOTICE to the Company under regulation 28(4) of the Water Supply (Water Quality) Regulations 2016 (as amended) that it must satisfy the following requirements:

For risks associated with:

  • Disinfection- Turbidity -2023/0117337

Requirements

(a) to maintain the following measures for the period specified in each case

  1. Operation of Mosswood WTW in accordance with Company policy, procedures and to internally agreed process parameters.
    Date: Ongoing for the duration of notice
  2. Proactive management of Mosswood WTW and network to minimise the risk to disinfection.
    Date: Ongoing for the duration of notice
  3. Ongoing monitoring of regulatory and operational sample results, on line data for disinfection parameters.
    Date: Ongoing for the duration of notice

(b) to review, revise and/or make operational the following measures, by the dates specified below:

  1. Confirm appropriateness of identified solution.
    Date: 31st December 2020
  2. Complete the planning, design and procurement arrangements for the construction of an additional Ultraviolet filtration stage or other agreed solution.
    Date: 31st December 2020
  3. Complete the construction, installation and commissioning of an additional Ultraviolet filtration stage or agreed solution.
    Date: 31st December 2022
  4. Confirm need and if appropriate the arrangements for cleaning / refurbishment of the existing Contact Tank at Mosswood WTW.
    Date: 30th April 2020
  5. Investigate the turbidity issues at Mosswood WTW and provide a report with evidence to demonstrate compliance with Regulation 26 including root cause  and any further mitigation required.
    Date: 31 December 2023
  6. Complete and commission further mitigation identified in step (b) 5.
    Date: 31 December 2024

(c) to audit whether the measures have been effective by the following means:

  1. Design and keep under continuous review an audit strategy to confirm the effectiveness of the measures delivered in parts (a) and (b).
    Date: Within 2 months of the issue of this notice and as required.

(d) not applicable

(e) to provide the following information in the time and manner specified below to enable monitoring of progress towards the mitigation of the risk of supplying water that would constitute a potential danger to human health:

Provide a progress report annually by 31 January and against the following milestones:

  1. Submit an audit strategy
    Date: 31 December 2019 and as required.
  2. Completion of the planning, design and procurement arrangements for the construction of an additional Ultraviolet filtration stage
    Date: 31st January 2021
  3. Completion of the construction, installation and commissioning of an additional Ultraviolet filtration stage
    Date: 31st January 2023
  4. Confirm need and where appropriate the arrangements for the cleaning / refurbishment of the existing Contact Tank at Mosswood WTW
    Date: 31st May 2020
  5. Provide a report of the completion of step (b) 5 including root cause for turbidity and any required mitigation to ensure compliance with regulation 26
    Date: 31 January 2024
  6. Provide confirmation of the completion of the construction and commissioning of mitigation required in Step (b) 6.
    Date: 31 January 2025
  7. Review the risk assessment for Mosswood WTW as required by Regulation 28(4) and subsequently submit a revised Regulation 28 report accompanied by a signed board level declaration.
    Date: 31st January 2025
  8. Submit a satisfactory completion report3
    Date: 31st January 2026

Failure by the Company to comply with this Notice may result in enforcement proceedings under section 18 of the Act.
